General Power of Attorney Template

1. FINANCIAL POWERS

To ask, demand, sue for, recover, collect, receive, and hold all sums of money, debts, rents, dues, accounts, legacies, bequests, interests, dividends, annuities, and demands whatsoever, which are now or shall hereafter become due, owing, payable, or belonging to me, and to have, use, and take all lawful ways and means for the recovery thereof; and to compromise or settle any claims or disputes related thereto.

2. BANKING AND INVESTMENT POWERS

To make, endorse, accept, receive, and deliver all checks, drafts, bills of exchange, promissory notes, and other commercial paper; to deposit, withdraw, or transfer funds to or from any bank account, savings account, credit union account, or other financial institution account in my name or jointly with others; to open or close any such accounts; to deal with, invest, or dispose of any stocks, bonds, mutual funds, or other securities registered in my name.

3. REAL ESTATE AND PROPERTY POWERS

To bargain, purchase, lease, or acquire, and to sell, mortgage, exchange, assign, surrender, or release any real estate, lands, tenements, or hereditaments, or any interest therein, upon such terms and conditions and for such consideration as my Agent shall deem fit and proper; to manage, repair, or maintain any real property I own; to collect rents, pay property taxes, and handle all matters relating to my real estate holdings.

4. BUSINESS OPERATIONS

To manage, operate, and transact any lawful business interest I may have, including entering into contracts, hiring and firing employees, and making all necessary decisions for the effective operation of such business.

5. LITIGATION AND LEGAL MATTERS

To commence, prosecute, defend, compromise, settle, or abandon any action, suit, claim, or proceeding, either in law or equity, relating to me or my property; to retain legal counsel, accountants, and other professionals on my behalf.

6. GOVERNMENTAL AND TAX MATTERS

To prepare, sign, and file any reports, declarations, petitions, tax returns, claims, or other documents with any governmental agency or authority, whether local, national, or international.

7. PERSONAL CARE AND WELFARE (Optional – if desired for specific types of POA)

  • To make decisions regarding my healthcare, medical treatment, hospitalization, or residential care.
  • To access my medical records and communicate with healthcare providers.
  • (NOTE: For detailed healthcare decisions, a separate Medical Power of Attorney or Advance Directive is often recommended.)

EFFECTIVE DATE: This Power of Attorney shall become effective immediately upon its signing.

DURATION: This Power of Attorney shall remain in full force and effect until revoked by me in writing, or upon my death, or upon the death or legal incapacity of the Agent, whichever occurs first.

REVOCATION: I reserve the right to revoke this Power of Attorney at any time by giving written notice to the Agent and to any third parties who may have acted in reliance upon this Power of Attorney.

INDEMNITY: I hereby ratify and confirm whatsoever my Agent shall lawfully do or cause to be done by virtue of these presents. I also agree to indemnify and hold harmless my Agent from any loss, damage, or expense arising from the proper exercise of the powers herein granted.

GOVERNING LAW: This Power of Attorney shall be governed by and construed in accordance with the laws of Kenya.
